Terms and Conditions of Use

1. Identification

These terms govern the use of the Bookgeist app (iOS and Android) and the website https://bookgeist.app, owned by Luis González López, Tax ID 12.335.592-W, address Calle San Miguel 13, Bajo. 47400 Medina del Campo (Valladolid), Spain. Support contact: support@bookgeist.app.

The website includes a contact form and an Android beta waitlist; data you submit through them is handled according to the Privacy Policy.

2. Acceptance

By downloading, installing, or using Bookgeist, you accept these terms. If you do not agree, do not use the application.

Bookgeist is intended for people aged 13 and over. If you are between 13 and the applicable age of majority, you must use it with any authorization or supervision required by the law of your country and the rules of your family account or store. If you are under 18, you represent that you have permission from your parent or guardian to use connected or AI features where their providers require it. In Spain, if processing is based on your consent and you are under 14, that consent must be given by the holder of parental responsibility or guardianship. The 13+ rating describes content suitability and does not remove those requirements. See the Age Suitability Policy.

3. Description of the service

Bookgeist is or may be offered in the following modes:

  • Classic (free): Bookgeist’s base tier, with unlimited books and sessions and the local and connected features identified as included. Core local features work without an account and primarily offline; optional connected features require a network connection and some may have usage limits.

  • Studio (monthly or annual subscription): adds AI features and other recurring services, permits Stamp Pack purchases, and may include a monthly Stamp grant while the subscription remains active. Account features require creating an account.

  • Lifetime (one-time purchase): permanent access to present and future local Studio-tier features, plus automatic cloud backup up to 5 GB. It includes native OCR in both the notebook and active reading sessions and permits Stamp Pack purchases and use of Stamps with compatible AI features; it does not include monthly Stamps, Studio-only recurring connected services, or the future social layer.

  • Stamp Packs (consumable purchase): usage credits for compatible AI features in Studio and Lifetime, bought as a one-time purchase when the user needs additional capacity. They do not renew automatically, and purchased Stamps do not expire.

  • Tips (voluntary consumable purchase): contributions to support Bookgeist that do not require a Bookgeist account or grant features; see section 5.

The Bookgeist account is optional and enables connected features. Core local features do not require an account or mandatory sync.

We may modify, add, or remove features to improve the service. If a modification substantially affects a paid feature, we will communicate it.

4. Accounts

Core local features do not require an account. To use connected features, you may create an account with a verified email or compatible identity provider, and you are responsible for keeping your credentials confidential.

Before creating an account, the Privacy Policy and account-deletion document explain the data processed, authentication, sync, retention, and deletion.

5. Payments, renewals, and refunds

Purchases available in the app are processed through the App Store (Apple) or Google Play (Google). We do not receive or handle your payment data.

  • Monthly or annual Studio subscriptions renew automatically unless you cancel from your Apple or Google account settings at least 24 hours before renewal.
  • Cancelling Studio turns off the next renewal; access continues until the already-paid period ends. Uninstalling the app or deleting a Bookgeist account does not by itself cancel the store subscription.
  • Lifetime is a one-time non-consumable purchase with no automatic renewal. Restore it on compatible devices signed in to the same Apple or Google account using the app’s Restore purchases option.
  • Each Stamp Pack is a one-time consumable purchase and does not renew. Purchased Stamps do not expire, and their balance is linked to the Bookgeist account used for the purchase so it can be retained and synced. Store purchase restoration does not redeliver Stamps that were already spent; signing in to the same Bookgeist account recovers any balance that remains available.
  • Refunds are governed by Apple and Google policies and must be requested through them, without prejudice to your consumer rights under Spanish and European law.
  • Price changes are not applied retroactively to completed purchases. The price of future renewals may change with the notice and, where applicable, consent required by the App Store or Google Play; you can review the current renewal amount in the store before renewal.

Tips

Tips are voluntary contributions made through a consumable purchase. You can make them repeatedly; they do not renew, unlock features, or change your plan or Stamp balance. Refunds follow the general purchase conditions set out in these terms.

They do not require a Bookgeist account. Their voluntary nature does not limit the consumer rights set out in these terms.

6. One-time purchase and subscription: scope

Classic is the free base tier and does not require a purchase. A Lifetime purchase grants you a perpetual, personal license to use on your devices the present and future local features assigned to the Studio tier, plus automatic cloud backup up to 5 GB while Bookgeist continues to offer that service. “Forever” means the license does not expire or turn into a subscription. The Lifetime license includes native OCR in both the notebook and active reading sessions. It also permits Stamp Pack purchases and use of Stamps with compatible AI features, but it does not include monthly Stamps, Studio-only recurring connected services, or the future social layer. We cannot guarantee the indefinite availability of connected services, compatibility with future versions of iOS or Android or future hardware, or that the app will remain available for new downloads if distribution ends. If a change materially affects a service included in a purchase, we will provide reasonable advance notice where possible and respect applicable consumer rights.

If a store or account retains a historical Classic purchase, Bookgeist may keep the minimum technical record required for restoration, support, refunds, or product transition. That historical record does not make the current Classic tier a paid mode.

7. Your content

The data you create in Bookgeist —books, sessions, notes, notebook, annotations— is yours. We claim no ownership over it. It is stored mainly on your device and leaves it only when you use a documented feature that requires an external service, such as metadata search, covers, purchases, crash telemetry, or AI features, as described in the Privacy Policy.

8. Use of AI features

Camera or photo-access permission allows you to capture or select images, but does not by itself authorize sending them to external AI. Native OCR is processed on the device. The local features in your plan remain available if you do not consent to AI transfers.

Studio Scan sends the cover, spine, or shelf photos you select to Bookgeist services and external AI providers to recognize books. AI features may also send descriptions, images, style and other settings, and technical or account identifiers needed to provide and protect the service and manage the plan and Stamps. Recipients, purposes, and retention are described in sections 7 and 8 of the Privacy Policy. These features do not process images exclusively on the device.

Separate consent is required before content is sent to AI, independently of accepting these terms or granting camera permission. You can refuse or withdraw it from the AI and privacy section in Settings. Without valid consent, the transfer is not authorized; after withdrawal, consent must be obtained again before new transfers can be authorized, but withdrawal does not undo transfers already made.

With valid consent, Studio Scan may prepare and preload a selected photo to Bookgeist services before you press the final recognition button. Transferring the image, starting analysis, and confirming books in your library are separate steps: cancelling analysis does not undo an upload already made, and uploading or analysing an image does not mean confirming those books in the library.

When you use AI features, you accept that:

  • You are responsible for the content you submit and for having the right to do so. Do not submit extensive excerpts of copyrighted works.
  • AI-generated content may contain inaccuracies; you should not treat it as exact or error-free.
  • AI-generated images are identified as AI-created.
  • You will not use these features to generate illegal, offensive, or rights-infringing content. You can report inappropriate content from within the app.

9. Account and data deletion

You can delete the account and associated server data through Settings → Account → Delete account, or request deletion using the contact published at bookgeist.app/delete-account. Local data is deleted separately by uninstalling the app or clearing its data from system settings. Scope, retries, and limited retention are described on that page and in the Privacy Policy.

10. Intellectual property

Bookgeist, its name, its mascot (Geisty), its design, its code, and its content are owned by Luis González López (Kalapps) or used with authorization and are protected. You are granted a limited, non-exclusive, non-transferable license for personal use of the app. You may not copy, decompile, redistribute, or commercially exploit the application.

Bookgeist includes ambient music and sound effects obtained from Pixabay and used under the Pixabay Content License and its binding terms. This license permits commercial use, copying, modification, and use without attribution, subject to Pixabay’s published prohibited uses, including the prohibition on distributing the content on a standalone basis. Bookgeist integrates this audio as a functional part of the application and does not offer it as a downloadable stock file or standalone product. Pixabay and its contributors do not sponsor or affiliate with Bookgeist.

11. Prohibited conduct

You may not: use the app for illegal purposes; attempt to access our systems without authorization; bypass usage limits or technical protections; disrupt the service; or abuse AI features.

12. Warranties and limitation of liability

Bookgeist is provided “as is” and “as available”. To the extent permitted by law, we do not guarantee that the service will be uninterrupted or error-free. We recommend keeping your own backups of your data.

Nothing in these terms excludes our liability where, under Spanish and European consumer law, it cannot be excluded.

13. Suspension and termination

We may suspend or terminate access to server-side features or the Studio subscription in the event of a serious breach of these terms. You may stop using the app and delete your local data at any time.

14. Governing law and dispute resolution

These terms are governed by Spanish law. As a consumer, you may turn to the courts of your domicile and, where applicable, to a competent consumer alternative-dispute-resolution entity.
